Discovery has long been an important part of litigation, but the rapid increase of electronically stored information has dramatically raised the stakes – and the risks.
Heller Ehrman works hand-in-hand with our clients and their in-house professionals to develop an efficient and streamlined approach to preserving and producing electronically stored information. We offer a full-service discovery program to meet our clients’ needs, including litigation readiness analyses, document preservation and review, and data mining and collection.
We devise eDiscovery strategies tailored for each case. Our lawyers know that an individualized strategy is not only fiscally responsible, but also is best suited to ensure that our clients achieve a satisfying outcome.
Our Approach
In a world where electronic documents flow with an unprecedented degree of freedom, businesses face increasing challenges to comply with the expectations of the law. To ensure that the eDiscovery needs of each case are met, our attorneys work with clients from the outset of a case to identify discovery obligations and proactively address any potential issues. With years of litigation and trial experience, we know that eDiscovery is not merely about production. It is a critical component in developing an effective litigation strategy – and, when necessary, winning a trial.
We develop creative and cost-effective strategies to meet the specific needs of each case. When necessary, we employ contract attorneys and collaborate with discovery vendors to assist with the timely production of large-scale discovery. We also use a variety of internal litigation management applications to deliver efficient solutions to our clients. We have successfully managed hundreds of millions of documents for matters of all sizes by using these in-house databases.
And when sophisticated technology is required, Heller Ehrman employs its Practice Support personnel and third party vendors to assist on projects such as analysis of system architectures, restoration of back-up tapes, extraction of data, key-word searches, and file conversion for electronic review and production. We have also handled complex technical projects including forensic investigation and data reconstruction.
Our Experience
We have handled all aspects of discovery, from reviewing, coding and scanning almost 20 million pages of client documents, to imaging hard drives, restoring back-up tapes and extracting data from live servers in the United States and abroad. Our team of attorneys have led complex discovery projects throughout their careers and have the technical knowledge and experience required to effectively manage large-scale document collection projects and reviews.
