Recent days have brought a legal battle over jurisdiction between the Federal Energy Regulatory Commission (“FERC”) and the Commodity Futures Trading Commission (“CFTC”) over the reach of FERC’s new manipulation jurisdiction. This fight has arisen in the first major action that FERC has brought under its new authority, and the outcome could have profound effects on the role of the respective agencies in overseeing trading of energy products and the standards that will be applied to that trading in the coming years.
