
Insurance Class Action Victory

Heller Ehrman recently assisted a leading insurance company to secure a victory in the New Mexico Court of Appeals. The case originated in February 2004 when the client was sued in the New Mexico District Court in a putative, class action lawsuit that involved 16 states and millions of policyholders alleging approximately $270 million in damages. The action was based on a pricing theory that the plaintiff's counsel had successfully asserted against several other insurers. Heller Ehrman obtained summary judgment in the trial court, and successfully defended the trial court victory.
