The Class Action Fairness Act of 2005 became law today. The Act substantially restructures practices and procedures for all newly-filed, multi-state class actions – moving many such cases from state to federal courts. The Act applies only to cases "commenced" after its enactment. This bulletin summarizes the new law and discusses several possible issues presented by its implementation.
