Barry Tucker joined the firm in 1999 and practices litigation.

Experience

Mr. Tucker's practice emphasizes intellectual property and commercial litigation. He represents a variety of technology companies, including those in the telecommunications, semiconductor, biotechnology and medical device industries.

Mr. Tucker was chosen by the federal judges of the U.S. District Court for the Southern District of California to be a lawyer representative for the Ninth Circuit Judicial Conference, and he recently concluded a three year term.  As part of that service, he gave a presentation to the S.D. Cal Judges on the Southern District of California’s new patent local rules. 

He is an eight-time recipient of the Wiley W. Manuel Pro Bono Award from the State Bar of California and a four-time recipient of the Legal Aid Society’s Outstanding Pro Bono Service Award.  Mr. Tucker also was named in the 2007 and 2008 editions of Southern California Super Lawyers as one of the top IP Litigation lawyers in San Diego, and the 2008 edition of Super Lawyers, Corporate Counsel Edition for Intellectual Property Litigation.  Mr. Tucker serves as immediate-past president of Legal Aid Society of San Diego, Inc. after completing a two-year tenure as president.

Representative Engagements

  • In the Matter of Certain Semiconductor Integrated Circuits Using Tungsten Metallization and Products Containing Same, ITC Investigation No. 337-TA-648.  Represents multiple respondents in this investigation involving a patent concerning a process for manufacturing semiconductor integrated circuits.
  • RAKTL (Ronald A. Katz Technology Licensing)  Represents RAKTL in a series of multi-district patent infringement litigation cases involving an extensive portfolio of computer telephony patents.
  • Zoltar Satellite Alarm Systems, Inc. v. SnapTrack, Inc. and Qualcomm Inc. Represented the defendants in obtaining a complete defense victory on all infringement claims after a three-week jury trial.  This patent case involved position location technology utilized to locate wireless telephone users who make 911 calls.
  • Qualcomm v. Motorola. Represented Qualcomm in five related cases against Motorola involving design and utility patent claims, trademark claims, trade disparagement claims and other related matters.  Claims by Motorola for damages and injunctive relief were successfully resisted and a very favorable resolution was obtained, culminating in an agreement which served to hasten the development of CDMA.
  • Kintera v. Convio. Represented Convio in a case involving claims of trade secret theft, copyright infringement, trademark infringement and unfair competition regarding software utilized for Internet fundraising applications by non-profit organizations.
  • MorphoSys/Cambridge Antibody Technology. Represented MorphoSys in patent litigation against Cambridge Antibody Technology.
  • Diatek v. Ohmeda. Represented Ohmeda, a division of British Oxygen Corporation in defeating Diatek’s claim for injunctive relief and defending damage claims of $50 million growing out of allegations of breach of an exclusive distributorship agreement and unfair competition.  After a four-week trial, the claims for injunctive relief were denied and only a small fraction of the damages sought were awarded.
  • Jostens v. Perkowski, et al.  Represented Jostens Inc. in successfully obtaining temporary restraining orders and preliminary injunctions preventing the solicitation of Jostens’ accounts by their former sales representatives.  Additionally, tried a contempt of court motion, resulting in the defendant Perkowski being held in contempt of court with regard to violation of the temporary restraining order.
  • Jostens v. Chicca. Obtained summary judgment dismissing Mr. Chicca’s employment and breach of contract claims, and obtained summary judgment on Jostens’ counterclaims of trade secret theft and breach of contract.
  • Mail Boxes Etc. v. Ogilvie.  Obtained a stipulated permanent injunction on behalf of Mail Boxes Etc. against a former franchisee relating to trademark infringement, trade secret theft and unfair competition.
