Eric Shapland joined the firm in 1997.  He is a member of the firm’s Antitrust & Trade Regulation Practice Group and its Appeals & Strategy Group.

Experience

Mr. Shapland has represented a variety of Fortune 500 companies - from industries as diverse as residential construction, tobacco and computer software - that are facing suit under state and federal antitrust laws.  In those representations, he has been responsible for developing strategies for trial, dispositive motions and class certification proceedings.  Mr. Shapland has also second chaired a federal jury trial and several arbitrations, briefed and argued motions in both federal and state court, and argued before the California Court of Appeal.

Representative Engagements

  • Represented Philip Morris USA Inc. in its defense against claims based on the industry-wide settlement with 46 states over tobacco related health care costs. 
  • Represented Microsoft Corporation in its defense of against claims brought by Sun Microsystems, Inc. as follow-on litigation to the DOJ's antitrust action against Microsoft.
  • Represents California Common Cause in support of California's effort to enforce its campaign contribution disclosure requirements against Indian tribes.  With Common Cause's help, California secured the first court of appeal decision holding that a tribe was subject to suit in the absence of tribal or Congressional consent.
