Daniel Kassabian joined the firm in 2004 and is a member of the Intellectual Property Litigation Practice Group.

Experience

Prior to joining Heller Ehrman, Mr. Kassabian was an associate at a prominent California law firm, where he practiced general litigation with an emphasis on intellectual property litigation. Mr. Kassabian has represented both plaintiffs and defendants in patent litigation, including lawsuits concerning computer software, semiconductor devices, semiconductor manufacturing, business methods and pharmaceutical drugs. Mr. Kassabian also has represented clients in trade secret cases, trademark and copyright matters, domain name disputes, contractual disputes, employment matters, and class action products liability.

While attending Harvard Law School, Mr. Kassabian represented indigent tenants in landlord/tenant disputes. He was also a teaching fellow in Harvard University’s Department of Economics.

  • AMC Tech., L.L.C. v. SAP AG (E.D. Pa.). Represents defendant-accused infringer in a copyright, trade secret and breach of contract case involving customer relationship management software. 
  • The Original Creatine Pat. Co. v. MET-Rx USA, Inc. (E.D.N.Y.). Represents defendant-accused infringer in a patent infringement case involving neutraceutical products and administration.
  • Nutramax Labs., Inc. v. Pharmavite, LLC (D. Md.). Represents defendant-accused infringer in a patent infringement case involving neutraceutical products.
  • Symantec Corp. v. Altiris, Inc. (E.D. Tex.). Represented plaintiff-patentee in a patent infringement case involving technology for computer and network administration.
  • Revivant Corp. v. Fogarty (N.D. Cal.) and Fogarty v. Revivant Corp. (N.D. Cal.). Represented defendant and declaratory plaintiff-patentee, a manufacturer of a medical device that automatically administers CPR, in inventorship dispute and breach of contract cases.

  • Siliconix inc. v. Advanced Analogic Techs., Inc. (N.D. Cal.). Represented plaintiff-patentee, a semiconductor device manufacturer, in a patent infringement case.
  • Siliconix inc. v. Alpha & Omega Semiconductor, Inc. (N.D. Cal.). Obtained a favorable claim construction ruling for the plaintiff-patentee, a semiconductor device manufacturer, which resulted in a favorable settlement.
  • ZiLog, Inc. v. QuickLogic Corp. (N.D. Cal.). Represented plaintiff-patentee, a semiconductor device manufacturer, in a patent infringement case.
  • ALZA Corp. v. IMPAX Labs., Inc. (N.D. Cal.). Represented plaintiff-patentee, a pharmaceutical company, in a patent infringement case.
  • Farmer v. Medo Indus., Inc. (C.D. Cal.). Part of team that obtained summary judgment of noninfringement for the defendant-accused infringer, a car accessories manufacturer, in a case involving patents for automotive air fresheners.
  • Knauer v. Kaiser Permanente Int'l Inc. (N.D. Cal.). Represented the defendant, a healthcare provider, in a copyright infringement case relating to marketing campaign.
  • Webgain, Inc. v. Borland Software Corp. (N.D. Cal.). Represented plaintiff-patentee, a software developer, in a patent infringement case.
  • Metropolitan Life Ins. Co. v. Bancorp Servs., LLC (E.D. Mo.). Represented the defendant-patentee, a financial services firm, in a declaratory judgment action to invalidate patent.
  • Dainippon Screen Mfg. Co. v. CFMT, Inc. (N.D. Cal.). Part of a trial team that obtained a verdict of patent infringement and validity for the defendant-patentee, a semiconductor processing equipment manufacturer, in a jury trial involving patents for semiconductor manufacturing processes.

  • Mercy Servs. Corp. v. Melton (San Francisco Super. Ct.). Represented defendant-tenant in an unlawful detainer action on a pro bono basis.
  • Mayer v. CSC Consulting, Inc. (San Francisco Super. Ct.). Represented defendant, a consulting firm, in an employment case involving claims of fraud, breach of contract, wrongful termination, gender discrimination and harassment.

  • Jacobson v. Int'l House of Pancakes, Inc. (Contra Costa Super. Ct.). Represented the defendant, a restaurant franchiser, in an employment case involving claims of wrongful termination, sexual harassment and intentional infliction of emotional distress.
  • Heinrich v. Digex, Inc. (San Francisco Super. Ct.). Represented defendant, an enterprise hosting company, in an employment case involving claims of gender discrimination and harassment.
  • Janvrin Holdings Ltd. v. Hilsenrath (N.D. Cal.). Represented defendants, an investment firm and an outside director, in a suit for securities fraud.
  • Hering v. Jefferies & Co., Inc. (San Francisco Super. Ct.). Part of a trial team that obtained a verdict of no liability for the defendant, a securities brokerage, in an employment case involving claims of wrongful termination and gender discrimination.
  • Firoozye v. Earthlink, Inc. (San Francisco Super. Ct.). Part of a trial team that obtained a favorable settlement for the defendant, an Internet service provider, in a contractual dispute involving a software program used to cache web pages.
  • In re LifeScan (N.D. Cal.). Obtained a favorable settlement for the defendant, a medical device manufacturer, in a class action for alleged malfunctioning of blood glucose monitoring devices.
