Attorney Biography

Edward M. Joyce joined the firm in 2000 as a Shareholder. He is a member of the Insurance Recovery Practice Group.

Experience

Mr. Joyce has insurance coverage litigation experience in the areas of professional liability, employee dishonesty, directors and officers’ liability, business interruption, all risk, construction defect, intellectual property, advertising injury, business torts, products liability, employment liability and environmental liability matters. He has represented policyholders and clients which includes Fortune 500 companies, as well as small-and middle-market companies, in a wide range of industries. Industries he has counseled include food and beverage, industrial, textile, retail, real estate services and construction, media and entertainment, pharmaceutical, telecommunications, energy, financial institutions and municipalities. Mr. Joyce has secured over $500 million in verdicts and settlements in his representation of policyholders. He is the creator and Editor-In-Chief of Heller Ehrman's insurance coverage newsletter The Policyholder Perspective.

Prior to joining Heller Ehrman, Mr. Joyce was a partner with the law firm of Anderson Kill & Olick, where he co-chaired the Insurance Coverage practice group. He created and was editor-in-chief of their insurance coverage newsletter, The Policyholder Advisor. In addition, he held several leadership positions, including vice-chairman of the insurance coverage practice group and chairman of that practice group’s marketing efforts.

Mr. Joyce regularly speaks at industry functions and to media including CNNfn, The New York Times and Business Insurance on insurance coverage issues. He has published numerous articles on insurance coverage matters, including articles in Corporate Counsel Magazine and Corporate Legal Times, and has been invited to speak at the Risk and Insurance Management Society (RIMS) Annual Conference for the past 12 years.

Recently, Mr. Joyce was listed in Chambers USA 2006 as an "established name" practitioner for corporate policyholders in insurance coverage disputes and who, according to clients, "can really take charge of a negotiation and assemble an excellent team of lawyers who provide a high level of service."

Representative Engagements

  • Represented Rank Group Plc. (Hard Rock Café) in international litigation regarding its business interruption claims for the New York and DC Hard Rock Café restaurants as a result of the September 11, 2001, terrorist attacks.
  • Represented RAG American Coal Holding, Inc. in two major property damage, extra expense, business interruption claims following a mine fire and an explosion.
  • Represented Paxson Communications Corporation in multistate litigation regarding its property damage, business interruption and extra expense losses incurred as a result of the September 11, 2001, terrorist attacks.
  • Represented manufacturer in two week trial in Roskam Baking Company v. Northern Ins. of New York regarding insurance coverage for property and business interruption claims resulting from a catastrophic fire resulting in a judgment in excess of $10 million.
  • Represented municipalities in Compass Ins. Co., et al v. City of Littleton & City of Englewood, a landmark victory for municipalities and policyholders in insurance law, in which the Colorado Supreme Court ordered insurance companies to defend the Cities against environmental claims at the Lowry Landfill.
  • Represented construction company in Weitz/Citadel v. Tokio Marine & Fire Ins. Co., et al., in which a Florida federal court ordered Tokio Marine to defend Weitz/Citadel against construction liability claims.
  • Represented major steel manufacturer in litigation involving first party and business interruption claims resulting from an explosion at one of the steel manufacturer’s facilities.
  • Represented beer manufacturer in Adolph Coors Co. v. American Ins. Co., in which a Colorado federal court sanctioned Liberty Mutual for its “hardball litigation,” and ordered Liberty to defend Coors’ environmental claims and subsequently ordered Liberty to pay Coors’ insurance coverage attorney fees.
  • Represented shipbuilder in Avondale Indus., Inc v. Travelers Indem . Co., a landmark victory for policyholders in insurance law in the United States Court of Appeals for the Second Circuit.
  • Represented Connell Limited Partnership in Connell Limited Partnership v. Dayton Industries, Inc., a product liability case successfully argued in the United States Court of Appeals for the Second Circuit.
