Richard Cashman joined the firm in 2000 and practices securities and complex corporate, commercial litigation.

Experience

Mr. Cashman has had extensive experience successfully representing major corporate and individual clients before federal and state trial and appellate courts and arbitration tribunals in a wide variety of civil litigation matters in all phases of the litigation process.  He has represented major auditing firms, public and private corporations, corporate directors and officers, special committees, foreign sovereign nations, as well as individual clients.  His engagements have included securities class actions, takeover litigations, shareholder disputes, derivative suits, ERISA litigations, antitrust claims, internal investigations, international and domestic contract disputes, suits against and in defense of foreign governments, business torts, corporate raiding, unfair competition and trade secret cases, employment discrimination matters, real estate disputes, as well as libel, First Amendment and related publishing matters.  In addition to his practice Mr. Cashman also has committed himself to advancing the profession through Bar Association activities in the course of which he has been elected to significant leadership positions.

  • Representation of a major auditing firm in defense of shareholder and bondholder securities fraud class actions arising out of the bankruptcies of Laidlaw Incorporated and Safety Kleen Corp.
  • Representation of a major auditing firm in defense of investor securities fraud class actions arising out of the demise of offshore hedge funds.
  • Representation of a corporate officer in defense of claims arising out alleged backdating of stock options.
  • Representation of Visa in defense of consumer and antitrust claims arising out of credit card foreign currency conversion fees.
  • Representation of a generic pharmaceutical company in defense of consumer antitrust claims arising out of a patent litigation settlement requiring it to forego marketing of a generic pharmaceutical product.
  • Representation of a major electrical contracting firm in defense of an antitrust claim alleging a conspiracy with other contractors and a labor union in restraint of trade.
  • Representation of the Republic of the Philippines in connection with a suit seeking recovery of assets stolen by deposed Philippine president Ferdinand Marcos.
  • Representation of a purchaser of defaulted sovereign debt, resulting in the entry of an $87 million final judgment in its favor.
  • Representation of the Republic of Croatia in defense of a suit by a landlord after the United States sanctioned the former Socialist Federal Republic of Yugoslavia and closed its consulate in New York.
  • Representation of corporate directors in successful defense of civil RICO and securities claims asserting fraud in stockholder transactions resulting in the alleged seizure of control of a New York Stock Exchange listed corporation by its principal officers.
  • Representation of a life insurance company alleging securities fraud in the underwriting of high yield bonds issued by Insilco Corporation.
  • Representation of a publisher against a libel suit brought by an associate of  a notorious former CIA agent turned illegal arms supplier to Libya and Idi Amin.
  • Representation of an intervenor generic pharmaceutical industry association in defense of “paper” new drug application regulations adopted by the FDA which opened the market to generic pharmaceuticals.
  • Representation of a publicly held construction company against tortious interference claims arising out of a subcontract involving the renovation of a major hospital in New York.
  • Representation of a labor lawyer in the successful prosecution of a libel suit against a labor union which had defamed him in the course of collective bargaining negotiations.
  • Representation of a government securities dealer against claims of misrepresentation and inappropriate trading arising out of repurchase and reverse repurchase transactions.
