Brian Brosnahan joined the firm in 1984 and practices primarily in the areas of antitrust and unfair business practices. He has handled antitrust litigation and counseling engagements for clients in numerous fields, including the credit and debit card industries, pharmaceuticals, and medical devices. He is a member of the Antitrust & Trade Regulation, Complex Commerical Litigation and Consumer Litigation Practice Groups.

Experience

Mr. Brosnahan has provided advice and litigation representation to companies facing extremely serious or "crisis" litigation threats. Such representation has included antitrust or unfair business practices class actions (such as his representation of Visa U.S.A. Inc. in tying and monopolization litigation involving debit and credit cards and his representation of Providian Financial Corporation in various federal and state unfair business practices class actions). That representation has also included representation of clients facing severe tort exposures, where his experience in managing litigation and pursuing insurance carriers has proven invaluable in protecting his clients. As outside general counsel of the Franciscan Friars in the western states, he has helped the Franciscans avert financial disaster while resolving sexual abuse cases with compassion and dignity, setting a model since the early 1990s for how religious organizations ought to approach the sexual abuse crisis. While Mr. Brosnahan typically represents defendants, he knows the plaintiff side as well. Mr. Brosnahan has represented plaintiffs in antitrust and unfair business practices litigation and has frequently sued insurance carriers on behalf of large corporate insureds.

Mr. Brosnahan is the former co-chair of the Financial Markets and Institutions Committee of the American Bar Association’s Section of Antitrust.
